Idaho ATV Laws: Own and Operate your ATV Legally

If you own or plan on operating an ATV in Idaho, it’s important you know the laws and regulations that govern its registration and use. Failure to comply with state laws can result in hefty fines, your ATV being impounded, or in some circumstances jail time.

Idaho ATV Ownership and Registration

The following laws govern how ATV ownership and transfer must be documented with the state of Idaho, as well as whether it will require registration before it may be used. These laws are often similar to what you would expect when purchasing a new automobile, but there are a few differences to make note of. Failure to comply with these regulations will typically result in fines but can potentially lead to your ATV being impounded if there are multiple offenses.

Do I Have to Title my ATV in Idaho?

Yes§ 49-501 – The state of Idaho requires ATVs operated within their borders to be titled with the DMV before use, unless the ATV has an engine displacement of 50cc or less.


Do I have to Registered my ATV in Idaho if I use it on Private Property?

No§ 49-402 – ATVs operated solely on private property are not required to obtain registration with the state through the DMV or Parks and Recreation. If a vehicle is to be operated on state roads or land at any point, it will require registration.


Do I have to Registered my ATV in Idaho if I use it on Public Property?

Yes§ 49-402 – Idaho requires ATVs be registered when operated on roadways and state lands. Where allows by state, county or city law, an ATV may be registered for on-road use and must display a restricted use plate at all time. ATVs used on state land, not including any roadways, must obtain a certificate from a qualifying vendor which must be affixed to the license plate (if the vehicle is registered for on road use) or upon the rear fender of the vehicle. Non-resident ATVs must also obtain a temporary certificate before use on Idaho state property.

 

Idaho ATV Operation

The following laws establish how an a ATV may be legally operated within the state of Idaho, on both private and public/state owned property. While ATVs do have 4 wheels, they are designed for off-road use and typically do not meet federal safety guidelines. As such, the state created laws to limit their use and protect the public from accidents. Failure to abide by these laws will typically result in costlier fines and potentially jail time depending on the offense.

What is the Minimum Age to Operate an ATV in Idaho?

NA§ 49-302 – Idaho allows ATVs to be operated on private property with no age restriction, however operation on public/state land has very specific restrictions. ATVs which are registered for on-road use may only be operated by licensed riders (16 y/o). On public land, operators under the age of 16 must be supervised by an adult (within 300 ft) and have completed an ATV safety course approved by the Idaho Department of Parks and Recreation.


Can I Drive my ATV on Public Roads in Idaho?

Yes – The state of Idaho allows ATVs to be registered for on-road use, but only if the ATV meets Federal Safety Guidelines and it is operated on roadways which have been permitted by local government. The ATV must be registered and have an in-date tag applied before operation. All rules of the road apply to ATVs operated on public roads.

The following items are required by Idaho law to be installed upon an ATV or worn by an operator during use. Vehicles registered for on-road use must comply with all required motor vehicle equipment.

Helmet Required by operators under the age of 18 while operating an ATV on public roads/land.
Headlight(s) Not Required but recommended by the Idaho Parks and Rec Department.
Tail Light Not Required but recommended by the Idaho Parks and Rec Department.
Muffler Required and must reduce the exhaust to less than 96 decibels.
